>THREE VITAL CITY COUNCIL MEETINGS WERE HELD THIS WEEK
March 15, 2012 – IML News – This week has been a busy week of meetings for the City of Iron Mountain Lake. On Monday there was a Public Hearing to amend Ordinance #36, followed by the regular monthly City Council Meeting. And then on Wednesday there was a follow-up meeting to cover the remainder of the amendment to Ordinance #36 and also the approval and signing of a contract with Taylor Engineering to begin the assessment and acquisition of funding for the sewer plant updates and improvement projects.
Briefly, we will cover the highlights of the meetings and then encourage you to listen to the audio of the meetings for all the details.
Monday at the special Public Hearing the Board of Alderman amended Ordinance #36 whereby the owner of the property is now solely responsible for the payment of sewer bills, whether or not the property is leased or rented to other individuals. No longer will renters or those who lease be able to put a sewer bill in their name. The owner of the property will be billed and held responsible for the payments. It was determined by the Board of Alderman that this was a better way of collecting payments, since on many occasions renters or leasers would run up a sewer bill and then “skip out” on the bill, making it nearly impossible to collect on the monies owed to the City. The City is striving to hold all property owners accountable for their sewer bills. In doing so, they are working diligently to be able to hold down possible rate increases. The amendment was read twice and then the Board unanimously voted to accept this amendment to Ordinance #36.
Following the Public Hearing, the regular City Council Meeting was held. Several amendments were made to the agenda, which included a surprise honor to be given to Ms. Mary Self, a long time resident, historian and friend to the City of Iron Mountain Lake. She was honored with a proclamation presented by Interim Mayor Goodman and was also given a key to the City.
During the meeting, several of the items on the agenda were tabled until Wednesday since some information was not available due to the absence of the regular City Clerk. Also tabled, until Wednesday, was the contract with Taylor Engineering. This was done in order that some clarifications could be made with Mr. Tim Robbs regarding the contract.
The Police Department made some requests during their report. They asked for the purchase of a speaker for a siren, the purchase of four very good used tires for one of the police vehicles, the purchase of summer uniform shirts and the purchase of ammo for firearms qualifications. All of the requests for improvements were granted. Also during the Police report the Board of Alderman voted unanimously to place IML Police Sergeant Larry Lavander on salary, which would eliminate any possible over-time hours and be a benefit to the City.
During the new business of the City the Candidates for the upcoming April 3, 2012 election was introduced. In Ward 1 the race is being contested between incumbent Alderman Dan Edwards and Mark Wynes. In Ward 2 it is a contested race between Brenda Goodman and Charles Wiles, a registered write-in vote. Ward 3 is uncontested with only Dustin Steinc appearing on the ballot. And for Mayor it is a contested race between current Alderman in Ward 2/Interim Mayor Brian Goodman and Phil Fox, who has also served the City as an Alderman in Ward 2. It is to be mentioned that former Mayor, Eugene Henson, is no longer running for the position of Mayor.
Also on the agenda were Mr. Steve Dickey with Bismarck Rural Fire Protection and Mr. Chris Gibbons with the Bismarck Fire Protection District. Both men were given time to speak to the Board and the people in attendance. Mr. Dickey assured the people that they, Bismarck Rural Fire Protection, would continue to serve the community, as it has for over 50 years, and Mr. Gibbons presented a proposal for the funding of the Fire Protection District through a tax levy, which is to appear for your approval on the April election ballot. For more information on the tax levy proposed you can read the article that appeared on Wednesday, March 14, 2012 in the Iron Mountain Lake News, “THE BISMARCK FIRE PROTECTION DISTRICT WANTS YOU TO VOTE “YES” FOR THE TAX LEVY ON APRIL 3 rd, 2012”.
On the Wednesday, March 14, 2012 Special City Council Meeting the financial report was read and the bills were voted on to be paid.
Following was a question and answer period with Mr. Tim Robbs of Taylor Engineering regarding the contract. Questions posed included what services are to be rendered and any fees and payment arrangements. It was noted that $10,000.00 would be the fee for the first portion of the project. This portion only includes the assessment and the organizing of any information, and submissions, needed to acquire the necessary funding to complete the project. The fee is to be paid as services are rendered, up to, but not exceeding, $10,000.00. Once this portion of the process is completed another agreement would be needed for the firm to over-see the project to its completion. Mr. Robb estimated that the first portion of this project could be completed within 6 to 9 months. The contract was approved by a unanimous vote of the Board of Alderman.
Also on the agenda was the amendment to Ordinance #36, whereby it would standardize sewer bill collections, disconnections, payment arrangements, re-connections, fees and deposits. It was deemed in the amendment that unpaid payments that exceed three (3) months would be subject to disconnection. Upon the third month of being past due a registered letter would be issued and expediently there after the service would be disconnected. A contract for payment arrangements could be arranged. This would require that the past due amount be paid in three equal payments, plus the regular monthly payment amount. If at any time this payment plan is breeched, services will be disconnected immediately. Once a disconnection has occurred the total past due amount plus a re-connection fee of $225.00, and a security deposit of $50.00 must be paid, in full, before any service is restored. The amendment was read twice and voted for unanimously by the Board of Alderman.
In regards to the sewer account City Clerk, Sarah Douglas, was pleased to report that collections were up substantially. As of two months ago timely payments were only 120 – 150 out of 294 accounts. Recently it is averaging 200 out of 294 accounts. She wanted also to assure that everything is being done to make sure that everyone who receives service is also receiving a bill and that collections are being handled vigorously to ensure that everyone is paying their fair share toward the sewer account in a timely manner.
